I had a friend deposit a check for me in her account,,,($4800) the next day she wrote me a check on her account and I went to the bank and cashed it,,the money was in her account,,,now the bank is telling her that the account that the check was originial drawn on does not have the funds in the account,,,who is responsible for the funds,,her,,,me,,,or the person who sent me the check in the first place...?????

You owe your friend the money back, who in turn owes it to the bank, who in turn will give your friend the check that was deposited back, so you can then persue the person that gave YOU the check in the first place.

How can you possibly think otherwise?

yes the money must be returned,,,,but from a legal standd point I think the writer of the orginial check is responsible,,,,

He is. Now, choose from the following list who should have the responsibility for going after the person who wrote the check:

1) the bank where it was deposited,
2) your friend, or
3) you.

Hint: The bank accepted a promise from your friend, your friend accepted a promise from you and you accepted a promise from the person who wrote the check.

If you can't guess the legal answer, just focus on the fact you have created a problem for your friend and you should be the one to fix it.
