I am getting married soon and was wondering what happens if someone issues a gift in the form of a check with my maiden name on it? First off, I am getting remarried, but the invitations will have the maiden name on them from before.

Jane Doe maiden
Jane Smith married (1st time) and currently being used for my checking account.
Jane Roberts - will be new name.

I don't have any existing "proof" other than a birth certificate of my given "maiden" name.

will this pose any problem if the check is written to Jane Doe? Can I endorse: Jane Doe aka Jane Smith?

You should contact your bank and see if they will accept checks payable to a name other than what is on the account.

If you do not have any identification with the name that matches the payee, we would not cash that check for you. aka will not work.

Where I am, we know you under your maiden name and we would ask for proof of your married name (ie: a copy of your marriage certificate) and then have you endorse with both the maiden and married names. As mentioned above, please check with your local institution.

I am guessing that if i present my birth certificate when depositing the check that would not be a problem?

I have been in that situation having been recently married... I assume you were wanting to CASH the check and not just deposit the check. All my gifts were deposited into an accout that my and my boyfriends (at the time) name was on. Now alot of people are skeptical about having joints accounts even when they are married, so I would hope providing a picture ID, birth certificate and the original marriage license (depends on bank some will not accept a copy) you should be able to CASH the gift. If you were just depositing the check in your account there should not be any problem.
