I received a property damage check from my insurance company, but my home is now in foreclosure. Who is entitled to the check?
If the loss was to personal property (furniture, computers, etc.) that's not part of the building, the check is probably in your name only, and you're entitled to the proceeds. If, however, the loss was to the home itself, the check should have been issued jointly to you and the lender or mortgage servicer. You will have to surrender the check to the lender or servicer, and it will be credited to your loan balance in the foreclosure proceedings.
