I am divorcing and would like to know if I can take my spouse off the mortgage and deed of the house. I am taking sole posession in an agreement.
It's good that you realize that approval of the agreement between you and your spouse, even after it's approved by the divorce court, doesn't affect your ownership of the house or the mortgage loan. You will need to discuss this matter with whoever holds your mortgage. You will probably have to provide the lender with current personal financial information, and the lender will verify your employment, income, assets, and credit history just as if you were applying to refinance the loan.
If the lender accepts you as credit-worthy in your own right, it may allow the mortgage loan to be amended to drop your spouse and permit the transfer of title into you individually. There may be a fee to make these modifications, but it should be considerably less than the usual front-end fees on mortgage loans.
