My ex-wife went to the bank and made a loan against my house. The loan officer knew I wasn't there, and the bank got two witnesses that work in the same bank, and the bank notary, notorized it. I didn't sign the note and didn't make the note, now the bank says I have to pay $106,000.00 for a loan I didn't make. It's all the bank's fault for watching her do it. I shouldn't have to pay for a loan I didnt make and shouldn't lose my house for a loan I didn't make. That's the bank's bad judgement. The bank is guilty not me! I'm innocent. I dont blame my ex. either, because if they had stopped her it never would have happened! Should I have to pay for a loan I didn't make or sign?! Can they take my home away from me if I stop paying for something I didnt do?
What you need to do is talk to the bank and tell them you didn't authorize a lien on your property. As it is your home, you do have a say. If the bank believes you owe the money, ask them why.
Next talk to an attorney and explain what happened and what the bank said. Ask your attorney about your rights to rescind the transaction.
With the facts laid out as you did here, you won't have to repay this and your lien will be released. Your ex-wife has a huge role here and she will be asked to give that money back.
