While married, I bought a house with my then husband. We have now been divorced for over a year. He is supposed to refinance and get the home out of my name, but he can't and he is now late on his payments. Is there a way to my name off the loan and this history off my credit report, since it is now doing harm to my credit? I have the signed divorce decree from the judge saying I am not responsible for his payments. I live in Michigan.
Your divorce decree is a separate court action from the joint debt to which you obligated yourself. To protect your credit, see that the payments are made. There is no incentive for a lender to release you, especially if payments are not being made.
You may be able to refinance the property in your name, or offer the lender a lump sum payment to remove you from the obligation. That isn't typical, however.
