I sent my mortgage payment for January to the bank in December. They mis-applied payment and finally fixed it, but the 2010 statement does not reflect accurate principal/interest year-to-date. They say they won't fix until year end. Is this legit?
There is no requirement for the bank to backdate and change your mortgage records under a given schedule. They have opted to not change the 2009 records, which may preclude you from filing a tax return now (either a corrected return or based on an extension with the IRS).
If this one payment makes an significant change on your tax liability and one that you can't recapture in 2010, complain to a bank officer, even the bank president. Explain what this will cost you and see if they can be motivated to either correct your entries, or offer you some other compensation to make up for your loss. They may waive fees on your account for some time, offer you some type of bonus certificate or they may have some other solution.
