My bank forced-placed flood insurance on my property, failing to notify me. They stated they attempted to notify me via certified mail to my home on two occasions. I never received anything. I have since obtained flood insurance, but they refuse to cancel the forced-placed policy, since it was outside the forty-five days notification that I never received. Why can't they cancel the policy?
Your lender likely has copies of the letters, or the returned, unopened, envelopes that were your notice. That is moot at this point, however.
Your lender was required by law to force place a flood insurance policy when you allowed yours to lapse. Property cannot be double insured in most cases, and your second policy may need to be canceled at this point. As the lenders policy comes due, you should be able to substitute your own for theirs. Coordinate your effort well in advance with your insurance agent and the lender.
