Cashing an Insurance Check for Repairs

I was issued a check from my insurance company for a claim on my house. The check has my husband and myself and the contractors name on it but the contractor will not sign it. Can I still deposit it into my account before it gets stale dated?


No, you can't deposit it. Based on the question, the check was issued as a result of a loss. The insurance company and any lienholder wants to ensure that the property is repaired the way that it is supposed to be. If the contractor performs work and later claims to have not been paid, they can put a lien on the property. This is why the check was issued payable to everyone who has to be happy with the final results.

You didn't indicate why they don't want to endorse the check. That is their payment for work performed. Whatever the problem, try to work it out with them and keep the insurance company (and any lienholder) informed about what is going on. Checks can always be reissued.
