Getting a Name Off a Loan

I have a loan with a person that I live with. At this time we are thinking of separating. We purchased vacant land together. His name is first on the loan, he has agreed that the land should go to me. How do I get his name off the loan.


Contact the lender that holds the loan and explain what you'd like to do. Lenders don't often want to release any of the joint borrowers on a loan, particularly if they relied on joint income to underwrite the loan in the first place.

That said, if your individual income and credit history are sufficient to qualify, the lender may be willing to let the co-borrower off the hook. If the lender isn't agreeable, you could try refinancing the loan in your individual name with another lender. In either case, there may be some legal fees involved, particularly if the names on the title to the land need to be changed.
