ID was Stolen and Check Cashed -- Am I Liable?

A check was cashed under my account for $900.00; my license and bank card were stolen, and now my bank is charging me for the $900.00! Am I liable for the money when it was fraud?


No, you should not be liable, but you'll need to work with the bank to demonstrate that you didn't cash the check. Did you notify the bank and/or the police that your ID and bank card were stolen? If you did that, particularly if you did so before the check was cashed, you have a pretty strong case.

Ask the bank to review its surveillance tapes of customers at the time they cashed the check, to see who actually cashed it. You know it wasn't you, so be prepared to identify who did it, if you recognize him or her.

Get started on this. The longer you take to initiate your claim, the harder it will be for the bank to figure out what actually happened.
