Endorsing Check for Incapacitated Individual

How do I endorse an insurance check made out to my mother, who had a stroke and is incapable of signing it? The money will be deposited in her account and my sister and I have joint POA. Do I bring the POA to the bank with me, and how do I endorse the back of the check? I appreciate any advice you can give me at this stressful time in my life.


If the bank does not already have a copy of the Power of Attorney, you should most definitely bring an original of that document with you. The bank may retain a copy, but it probably will not need to keep an original of the document.

Presumably, you will want to be added to your mother's account as an authorized signer if the POA document provides that authority. Depending on the wording of the POA, your sister may also have to be a signer on the account.

As for depositing the check, you and your sister if the POA requires you to act in unison, should endorse it in substantially this form, but not until the bank has agreed to accept it for deposit:

YOUR MOTHER'S NAME (as given on the payee line of the check)
BY: [your signature]
[Your sister's signature, if required]
Your name
[your sister's name, if required]
Attorney(s) in fact for
Your mother's name
