Filed for Bankruptcy: Bank Holds All Monies

My husband and I filed for bankruptcy Chapter 7 in October, including the Visa account in my husband's name only. We want to close our account, but they won't let us, and until this time, they are holding our money in our joint checking and savings accounts. Can they do that?


You need to speak with your bankruptcy attorney on this. Your deposit account is an asset that should have been reported by you, and likely collateral for the lender, based on your security agreement with them. Whether they are required to release these funds should have been discussed with the Trustee.
