A tenant mailed us a money order for her rent in June, but mailed it to the wrong address. We found out today that she endorsed the money orders on July 7th and July 9th. We still haven't been paid. Is it illegal to endorse money orders made payable to someone else?
Yes, if the money orders were payable to Party A and Party B endorsed them (or forged Party A's signature), it's theft. You are still due your money, and you have the right to demand payment from your tenant. If you can find out the particulars of the money orders, you can provide an affidavit that you never received, endorsed, or benefited from the money orders. That could enable your tenant to pursue a claim for a refund.
