Deployment, Foreclosure, Sale: What Can I Do?

I was deployed, and then when I returned, my house was foreclosed and sold within a month. Its been over a year now. Is there anything I can do to at least have some credit relief for this?


You have rights under the federal Servicemembers Civil Relief Act. Based on your brief description, the lender did not follow required procedures and you may well have a case against them that will help you recover the home or the funds. Your credit file will also require correction.

The process will likely not be a fast one, but you should contact a lawyer, JAG or otherwise. There are many states where lawyers offer free SCRA information and specific to your state laws. An internet search should help you on this in short order. Many states have protections in addition to the federal SCRA law so we recommend a local attorney.

In short, you should have had representation appointed for you by a court, you should have been contacted and they should have verified that you were or were not protected under the SCRA. The SCRA protections you had at the time will likely have prevented this. You should pursue your rights.
