My bank called me today. Due to human error, another customer has been depositing money in my account unbeknownst to me. The bank said I owe them for all money that was spent from my account due to their error, what are my rights?
Remember that Chance or Community Chest card that you drew in the game of MonopolyŽ that read "Bank error in your favor, collect $10"? Whether it's $10 or $10,000, it's a fantasy. You don't get to keep extra money that appears in your account in error.
Your rights? You have a right to try to settle on a repayment plan with the bank that won't require that you pay it all in a lump sum.
In all seriousness, you have a responsibility to notify your bank promptly if there's an error on your account, whether the error is to your detriment or not. As you have seen, delaying that notification only makes the problem bigger when the bank finally catches it on its own.
