A NY state tax refund check was issued to a husband and wife. The husband is deceased, though the check does not say "husband deceased". The bank states that NYS policy requires a reissue of the check as "husband deceased" or a reissue to the wife only. I do not see that statement written in NYS Tax websites. I think it is bank policy which is subject to manager discretion. What is the NY State law about surviving wife cashing a check made out to both husband and wife?
