I had under $10,000.00 deposited into my account. I contacted the bank immediately to tell them it wasn't mine, and they pretty much didn't want to know about it. I called four times, spoke to four different people and their advice: "We don't know anything about it, do with it as you please." Six months down the track, no money left and the bank 'suddenly' realized their error. Do I need to pay it back after they told me I could spend it?
You can be assured that the bank's version of history will differ from your narrative. It will be peppered with "we needed to research" and "we warned the customer that if we found an error ...." The bank will demand its money back and you'll argue that you were told to go ahead and "do with it as you please."
The childhood theory of "finders keepers" doesn't usually get much sympathy in court. Go ahead and make your case for not returning the money, but be prepared to lose the argument.
Our sympathies are with you, but our heads tell us the bank will win out if it pursues a legal case to recover the money.
