I scheduled an online bill pay to my landlord in the amount of $1300. When the check was sent out, it did not have the account number on it, consequently, the bank that received it credited an account I had charged off approximately thirteen years ago and will not give me back my money. Is this legal?
If the check was payable to the bank, it was probably legal. They received a check from you and you owed them money. Where should they have put the money? To them your debt was a logical place, but if your check was sent to that bank, payable to your landlord, the bank is not able to change the payee anymore than you could on a check you received in error.
Talk with a bank officer, about the particulars of your transaction. For future reference, do not ignore debts. They don't go away for a long time and new problems can arise when you can least afford them.
