Debt Collection Abuse

I had a collector who got new banking information from somewhere and debited my account for $400.00. I was not notified of this. Is this legal? What can I do?


You go to your bank and tell them you did not authorize this payment and you want to file a claim for an unauthorized transfer. We assume the transfer was electronic. Your bank will investigate the claim and determine if there was any authority to make this withdrawal. If they see no authority, they'll reverse the payment and collect the funds back from the payee.

You should consider two other things as well. First, consider complaining about this to your state banking commission or other authority such as the Federal Trades Commission about this practice. Second, you obviously still have an outstanding debt, assuming you are not contesting it, and need to make payment arrangements to address this.
