I have a negative checking account in the amount of $530. I made a deposit from another account, and withdrew some of the money before the checks cleared, and they bounced. I want to clear up the negative with the bank, but I cannot do it all at once. It has been two months. I spoke to a bank rep, who said they may charge it off in the near future. Could they also press criminal charges against me since they were my checks?
The bank could file a criminal complaint against you if state law permits it, but if you are actively attempting to repay this obligation, a criminal complaint isn't likely. Make an effort to get the problem resolved, so that that bank doesn't need to even consider filing a complaint.
As for charging off the balance of your account, that is something the bank will have to do if you don't first resolve the problem. Charging it off won't affect your obligation to repay it, though, so don't let the problem get compounded by thinking it will go away. With a charge-off may come a referral of information on the charge-off to a credit reporting agency, so your ability to open accounts at another bank could be hindered.
