POA Stealing from an Elderly Person

If someone is POA for an elderly person in a rest home, and that elderly person sells her home for a large amount of money, can the POA deposit that check into her own account without a signature from the seller and later withdraw all the money out and keep it?


It depends on the relationship and terms of the Power of Attorney as well as for what the funds are used. An investigation would be needed, and how easy this is to do may depend on the condition of the elderly person.

If possible, that elderly person should contact the police, if she feels that her funds were stolen, or the applicable state agency that handles cases of elder abuse. If the person is not capable, you could contact your state agency which handles elder abuse and provide them with the information you have. They can make a decision from there.
