Separated, Not Divorced: Entitled to IRA?

I live in Arizona, a community property state. I was separated from my husband and he transfered his IRA deposit to a new bank, where he told them he was divorced. They allowed him to open the account, naming his estate. They have taken the stand that I am not entitled to the IRA transfer and want to place it with the estate. Was this legal? The banker knew my husband was married, but claims otherwise. What can I do?


The best thing to do would be to quickly contact an attorney, so that you can undo any transfer to the estate that might reduce your right to the IRA balance.
