Using Retirement Security as Collateral

Three years ago my ex-husband loaned me 25K with my portion of the QDRO to secure it. It is coming due soon (+5K in interest) and I can't yet pay him back, and he's not willing to give me more time. I can't afford to lose my retirement. Is it possible to use the retirement security as collateral for a personal loan so I can pay him back now?


We don't know enough about the retirement plan to give you a final answer, but its likely you cannot. Because of the special tax treatment that many retirement funds receive, they are not eligible to be used as collateral. Many companies with 401K plans do allow loans against them, but there can be restrictions there as well. Ask the retirement plan administrator to be certain, especially considering the QDRO scenario you have.
