Hold on IRA: Legal?

I have an IRA account in one of the banks in North Carolina and I want to roll it over to another bank in FLorida. My bank is saying that I owe them vacation pay from last year! Do they have a right to put a hold on my IRA account without notification?


In most cases retirement accounts get a special preference and are not subject to holds or setoffs. Demand that the funds be transferred and tell the bank that if it is not done by a given date you will consult counsel. Then follow through with that. The IRA should be separate from their claim against you and has nothing to do with the validity of that claim.
