IRA Split with Divorce?

My wife and I are getting a divorce. I have agreed to divide my IRA with my wife. Can I split it up before the divorce settlement?


We checked with the IRS on this. They said that there are only two ways to move money out of an IRA other than by a regular disbursement. One is death. The other is under a Domestic Relations Court Order. You will have to ask the court to include the split-up of your IRA as one of the provisions of the Decree of Divorce, and you should do nothing before the order is issued.
