My father opened a safe deposit box. He put my name on it, and told me to go sign the contract. He passed away before I had time to do this. How will I be able to get into the box? I have a key. I had durable power of attorney over my father, not sure if that makes a difference.
The power of attorney was only effective during your father's lifetime; it is of no use now. Check with the bank. It would have every right to refuse to acknowledge you as a tenant on the box lease, but it may not take such a hard line. Be aware, however, that if there are any adverse claims on your father's estate, the creditors could attempt to extend their claims to anything of value that your father left in the box.
