Can I be accountable for depositing a scam check, when I called the bank immediately when I found out, to have it reversed? The banker said he would call the fraud department.
If you deposited that check and received credit for it, you are accountable for the amount of the check when it is returned unpaid to your bank. Do not spend any of the funds credited to your account represented by it.
You don't know what the bank's action will be at this point. The fraud department may only have been called so that the bank could be proactive about preventing loss. In that case, you might expect that the bank will place an extended hold on your account for the amount of the phony check, or charge the amount of the check to your account, to help you avoid spending those funds. There is a much more remote possibility that the fraud department might decide to also close your account out, since the bank does not want to do business with customers who deposit bogus checks. The more you work with the bank to assure that it will sustain no loss because of your deposit, the more the bank should be willing to keep you as a customer.
