I recently tried selling a vehicle online, received a check and my bank cashed it. After forwarding part of the money for transportation, it turns out the check has bounced and I've been scammed. I have the remaining money that I can give back to the bank, but am I liable for the rest? They cashed it knowing I didn't have that money in my account. I have receipts and have filed with the police.
Yes, you are liable. You agreed to pay the amount of the bogus check when you endorsed it. Your bank is entitled to collect the full amount of that check back from you. The fact that your bank accommodated you by cashing the check when you didn't have funds on deposit to cover it doesn't affect your liability.
