I received a check from a woman who had damaged my car. I endorsed it "for deposit to" my account number and mailed it to my bank. It never made it. It was cashed. I got the canceled check and the back is stamped "FOR DEPOSIT ONLY - UNITED STATES TREASURY" and it bears stamps of two banks I don't use. I think someone stole it from the mail and used it to pay their taxes. How do I get someone to investigate it?
The woman who wrote it refuses to sign an affidavit that the wrong person cashed the check. She says I am lying because the check was cashed, so she has done what she needs to and paid me for the damage she caused, but I received no money!
It's you who has to provide an affidavit that you didn't receive funds from the check, which you can attach to a copy of the check (keeping copies of everything) and a request that the check be replaced. The issuer of the check can then make its claim against the Federal Reserve Bank and U.S. Treasury, and the Treasury will have to deal with its taxpayer. Somewhere in that sequence, you should receive your money, from the original check issuer.
If you don't get results, you may have to try to collect on the original obligation that the check was issued for. Depending on the amount involved, you may be able to pursue that in a small claims court or through an attorney.
