Bank Cashes Forged Check; What do I do now?

My roomate wrote a $6000.00 check on my checking account and cashed it. How do I get the bank to refund the money to me and how long do I have to do it? Some time has elapsed and I didn't file a police report because I was scared of some people she knew.


Your bank's deposit agreement should indicate the time during which you are obliged to identify and report unauthorized items drawn on your account. If there no deadline in the agreement, your state's Uniform Commercial Code sets the time limit, which is one year from the statement date in most states (some states have shorter time periods).

Given the substantial amount involved, you should not expect the bank to simply refund the money without some effort to minimize its loss. You may even find that the bank refuses to pay the funds back without a court suit.
