Can my husband legally cash a check from my account without my permission?
No. You have a right to expect that your bank will only honor checks you signed. If your husband signed a check drawn on your account and you received no benefit from the transaction, you have a claim against the bank, assuming that you file the claim within the time frame set out in your bank deposit account. If there's no claim deadline in your contract, you have a year from when the statement reflecting the unauthorized payment was delivered.
