Can a bank refuse to investigate a fraud if an account holder opened an account using her friend's address as the mailing address? At the time of opening account, she told the banker she didn't have any address to use. The banker told her that she could use it. Weird thing was, she never saw this banker in person. All signatures and information were obtained by a friend of hers (non-banker), and phone. We strongly suspected that her friend and the banker were both involved in this scam/fraud, but then the bank just stopped the fraud investigation since she did not use her own address. My friend moves from place to place. She sub-let from people to save her rent. She has a huge family to support. Poor one, she lost $5000 in ten days. This bad person withdrew her money from convenient store ATM machines so there is no trace of images after thirty days. Really sad.
If I read your question correctly your friend used an address that wasn't hers. Someone stole money from her account at an ATM. If this is correct, your friend needs to tell the bank she is filing a Reg E claim on the account they allowed her to open. The fact that she used a different address than where she was living does not release the bank of its liability to investigate Reg E claims or take proper care of their customer. If the bank refuses, your friend needs to ask for the banks regulator and file a complaint.
