Fraud Victim Asks 'Who is Liable?'

I am a victim of fraud. I deposited a check; it cleared; I withdrew the money, then the bank declared it a bad check. Now I'm in the hole and the money is gone. Who is liable?


Not wanting to be the bearers of bad news, but you're probably on the hook for the money. If caught and successfully charged, the fraudster bears the liability for check fraud. However, unless you are able to recover from the fraud artist, you're the individual that got value from your bank when you deposited the check, and the bank has the legal right to pursue you for the overdraft in your account.
