I did not get my last paycheck and was told that they sent it to me, and it was cashed, but I never cashed it. They won't give me proof. I asked for a copy of the cashed check to see if I indeed either forgot or someone signed my name. Can I ask the bank to look it up for me somehow?
Your employer is obligated to pay you, and should be willing to provide you a copy of both sides of the check as evidence that it did so. Your employer's bank has no obligation to provide you a copy, however. If the check was intercepted and forged by a thief, your employer has not legally paid you, and you should press for a new check, by providing your employer an affidavit that you did not receive, endorse or benefit from the first check. Your employer can use your affidavit to initiate a claim against its bank, which in turn will make a claim against the bank that accepted the first check for deposit.
