I put the wrong account number for direct deposit of my IRS refund. It turned out the account existed and my money was deposited in it. It was my mistake, so the IRS is not going to reverse the deposit. The bank has filed a fraud dispute against the person who accepted the money into his account, but say my chances are limited in getting the money back. Do I have any other options? Can I sue or press charges against the person that accepted the money? Isn't it against the law to accept money into your account when you know it's not yours? Is the bank completely without liability here since they didn't match the name to the account?
The bank followed your instructions. You might have a claim against the person who is not returning your money for undue enrichment. Your state may have a law like this under that name or some other name. Essentially it says you don't get something for nothing, but you'll need to contact an attorney or your local police.
