Bank Cashes Forged Check, Takes No Responsibility

My son has a business that sent a check to the post office. The post office put it in the wrong box number. It was made out to Wash USA, which is my son's business. The back of the check was signed by a Medical Company, which doesn't exist. The bank that cashed it refuses to take responsibility. The company doesn't want to make out another check, because the bank will not credit the account. The check was for $1,600, and I know how much my son needs that. Is there any way that you can help?


Your son has to push the issuer of the check for a replacement based on the fact that he has not been paid what he was owed. He can provide the issuer with an affidavit that he did not endorse the check and received no benefit from it.

The check issuer can use that affidavit to push its bank to file a claim against the depositary bank (the bank that took the check for deposit from the medical company you mentioned). That bank, in turn, will collect the ill-gotten gains from the medical company. Once those funds have made it back to the issuer's bank, the issuer should issue a replacement check. It's convoluted, but that's the way such things have to be handled.
