My ex-wife took two checks that were written to my daughter and deposited them into her own account without my daughter's endorsement or knowledge. The checks had no endorsement or any thing else on the back of them. The bank took the money out of my ex's account and put it back into my account. Is it legal to deposit a check for someone else into an account (not the payee) without an endorsement?
No, the bank erred in accepting the checks for deposit to your ex-wife's account. They didn't correct their error when they moved the funds to your account, either. However, if you provide the funds to your daughter, she will have received what is due her, and all will be well.
If it looks like your daughter's checks are at risk if your ex-wife gets hold of them. Perhaps your daughter can look into protecting them better or having them delivered to a different address.
