In the summer of 2006, I was scammed out of $4,800 because my bank said that a check was good, but then charged me back a week later when the check came back as fictitious. In November 2006, an employee from BankSafe contacted me and told me that he could get my $4,800 back for a $295 fee.
I received documents from BankSafe and mailed them all of the pertinent information, but have not heard any response from them. The 800 number is connected and they are signing for certified mail, but they have not answered any of my questions. What should I do? Is there any way I can get the $4,800 back from the check?
There's not much information about BankSafe available, and what there is isn't favorable. It looks like you've been scammed twice.
Regardless of what you think happened, you weren't scammed for $4,800, because of anything that your bank did or said. You were scammed by whomever sent you the phony check. If your bank had been able to detect the forged check, it would have refused to accept if for deposit.
You appear to have been victimized a second time by yet another variation of an "advance fee" scam. Someone comes along and offers to help you, but you have to pay a fee up front before they can do anything. It makes no difference whether the scam involves a bogus huge sum of money that can be transferred to you in the U.S. only if you pay front money to pay taxes, or some similar fee, or you're asked to pay $295 up front for a finder's fee. It's all just a variation on the old "advance fee" scam.
Frankly, we're not at all hopeful about your chances for recovering any of these funds. The best you can hope for, we think, is to have acquired a healthy fear of these scams and anything like them. There really is not much hope that can be offered to you about your chances of recovering any of these funds.
