As a servicemember, I am worried that I will not be able to pay rent on the house where my spouse and I live when I enter active service. My spouse doesn't work on her own, and I pay for pretty much everything. Will my spouse be evicted if I can't pay while I'm away?

Section 527 of the No. Section 531 of the SCRA provides protection for servicemembers and their spouses/dependents from eviction from premises (i) that are occupied or intended to be occupied primarily as a residence; and (ii) for which the monthly rent does not exceed $2,400 (adjusted under certain other paragraphs of the Act). The landlord of the premises may not evict the servicemember without a court order. A court may stay the eviction proceedings for 90 days after application by the servicemember or on behalf of the servicemember.
