My brother-in-law passed away recently. His wife doesn't have any legal documents to be here in the United States. The only thing she has is their marriage license; can she get the money from her husband's bank account, which she desperately needs to pay the bills?

Some states have laws permitting a next of kin to access a decedent's account if the balance remaining is small. The limit varies from state to state. Banks are not required to honor such requests, however. The widow can approach the bank to ask whether it would entertain her request and what proof she would need of her identity and relationship to the decedent.
