I borrowed money for a truck, but never had the truck put in my name, so I didn't send the title to the bank and I don't carry insurance. The bank is threatening me with fraud charges; can they do that?
Yes. The loan contract you signed required you to provide the bank with a legal interest in the title of the vehicle and to keep it insured. That would require you to have legal ownership at the time of the loan, or immediately thereafter. By failing to complete your side of the agreement and not returning the loan proceeds, you could have exposed yourself to charges of fraud.
