Can Minor be Sued for Default of Loan?

If a minor had a car loan with a cosigner and the loan went into default, could the minor also be sued for recovery of the debt?



That will depend on the state laws, and very specifically, if this person is truly a minor. If the person was emancipated, he wouldn't be considered a minor.

In most cases the minor would probably not be asked for payment. The cosigner would be the first person sought after, but it could also be that the minor would be held liable when he reaches the age of majority. Again, it depends on the state laws.
