FCRA notices for business applications

Answered by:

Question:
If a denial was not based on information from the credit report, do we still need to list the credit score and key factors on the adverse action notice?
Answer:

If you didn’t use information in the credit report to deny credit, I’m going to assume you also did not use the credit score in your decision to deny credit. Thus, you should not provide the FCRA Notice or the Credit Score Information.
